Bylaw election process

C. Elections and Terms of Office:

 

  1. In all California special districts the number of years comprising director terms of office are staggered to provide for continuity in the service and/or operation of the district.

 

  1. To ensure this continuity, three directors shall serve four-year terms and twofour directors shall serve two-year terms.

 

  1. As a result of the staggered terms, every other year, elections for special district directors, based on terms, will rotate on two and four-year cycles on the November General Election ballot.


 

  1. Directors with terms expiring in the calendar year of the November General Election, and who desire to remain on the board, must file candidacy papers with the Plumas County Elections Office and meet all requirements to appear on the ballot.

 

  1. Directors appointed to the board to fill a vacant seat do not fill the term of office of the departing board member but rather they will fill the vacated seat only until the next election.

 

  1. Appointed directors who desire to continue serving on the board must also file candidate papers with the Plumas County Elections Office and meet all election requirements to appear on the ballot.

 

D. Vacancy/Vacancies to the Board:

 

  1. A vacancy or vacancies to the board must be filled in accordance with the California Elections Code (CEC).

 

  1. The basic requirements of the CEC mandate the district post a legal notice of vacancy or vacancies in the local newspaper for a minimum of two, consecutive weeks.

 

  1. After the closing date of the legal notice that requests interested members of the public to submit Letters of Interest to the district, an ad hoc committee may be formed by vote. The purpose of forming such a committeesuch committee is to review candidate Letters of Interest and to make a recommendation(s) to the board of directors at the next, noticed meeting.

 

  1. It is not within the authority of the ad hoc committee members to select and appoint a candidate to the board. The vote to appoint a new director shall only be made by a quorum of sitting directors.  The vote to accept the recommendation(s) of the ad hoc committee must be noticed on a posted agenda.

 

  1. In the circumstance where multiple vacancies result in the loss of a legal quorum, the district board has sixty-days (60) in which to identify sufficient candidates to serve on the board and legally form a quorum.

 

  1. When a potential candidate(s) to fill a legal quorum has/have been identified, the board shall notify, in writing, the Plumas County District 3 Supervisor so that he or she can present the names of the candidate(s) to the full board of supervisors for their vote to appoint the candidate to the district board.

 

  1. Should the district not receive any Letters of Interest or otherwise fail to identify a potential candidate(s) to form a legal quorum, the CEC requires the Plumas County District 3 Supervisor to select, present the name of the candidate(s) to the full board of supervisors and vote to appoint the eligible district resident(s) to the vacant seat(s).
